1. Introduction
This Policy defines the Operator's policy, procedure, and terms regarding the processing of personal data. It establishes procedures aimed at preventing and identifying violations, eliminating the consequences of such violations related to the processing of personal data, and also informs about the use, collection, storage, and management of personal data.
The Operator considers the observance of human rights and freedoms when processing their personal data, including the protection of the rights to privacy, personal and family secrets, as its paramount goal and condition for carrying out its activities.
2. Basic Definitions
- Personal Data - any information relating to a directly or indirectly identified or identifiable individual (personal data subject);
- Personal Data Operator (Operator) - a state body, municipal body, legal entity, or individual, independently or jointly with others, organizing and/or carrying out the processing of personal data, as well as determining the purposes of personal data processing, the composition of personal data to be processed, and the actions (operations) performed with personal data. For the purposes of this Policy, the Operator is recognized as Individual Entrepreneur Anton Ignasev;
- Automated Processing of Personal Data - processing of personal data using computer technology;
- Dissemination of Personal Data - actions aimed at disclosing personal data to an indefinite circle of persons or familiarizing an unlimited circle of persons with personal data, including the publication of personal data in mass media, placement in information and telecommunication networks, or providing access to personal data in any other way;
- Provision of Personal Data - actions aimed at disclosing personal data to a specific person or a specific circle of persons;
- Blocking of Personal Data - temporary cessation of personal data processing (except for cases where processing is necessary to clarify personal data);
- Destruction of Personal Data - actions as a result of which it becomes impossible to restore the content of personal data in the personal data information system and/or as a result of which the material carriers of personal data are destroyed;
- Depersonalization of Personal Data - actions as a result of which it becomes impossible, without the use of additional information, to determine the belonging of personal data to a specific personal data subject;
- Personal Data Information System - a set of personal data contained in databases and information technologies and technical means ensuring their processing;
- Cross-Border Transfer of Personal Data - the transfer of personal data to the territory of a foreign state to a foreign authority, foreign individual, or foreign legal entity.
3. Principles and Conditions of Personal Data Processing
3.1. What Personal Data Do We Collect?
Personal data that may be required when filling out online forms or job applications on the website, including your name, address, phone number, email address, resume/cover letter, work and education history, native language and other language skills, job preferences, including position, regions, and expected salaries, as well as any other personal data.
3.2. The processing of personal data is based on the following principles and conditions:
- Lawfulness and fairness;
- Limited to achieving specific, predetermined, and lawful purposes. Processing of personal data incompatible with the purposes of collecting personal data is not permitted;
- Combining databases containing personal data processed for incompatible purposes is not permitted;
- Processing of personal data excessive in relation to the stated purposes of their processing is not permitted;
- Ensuring the accuracy, adequacy, and relevance of personal data in relation to the purposes of personal data processing;
- Destruction or depersonalization of personal data upon achieving the purposes of their processing or in case of the loss of necessity to achieve these purposes, if the Operator cannot rectify the violations of personal data, unless otherwise provided by federal law;
- Processing of personal data to which an unlimited number of persons have been granted access by the personal data subject or at their request (personal data made publicly available by the personal data subject) is carried out without the subject's consent. Publicly available sources of personal data may include, with the written consent of the subject, their last name, first name, patronymic, date and place of birth, contact phone numbers, email address, information about profession, and other personal data reported by the subject;
- Processing of personal data is carried out with the consent of the personal data subject to the processing of their personal data;
- Processing of personal data is necessary for the performance of a contract to which the personal data subject is a party, beneficiary, or guarantor, as well as for concluding a contract on the initiative of the personal data subject or a contract under which the personal data subject will be a beneficiary or guarantor;
- Processing of personal data is necessary for the exercise of the rights and legitimate interests of the Operator or third parties or for achieving socially significant purposes, provided that the rights and freedoms of the personal data subject are not violated;
- Disclosure to third parties and dissemination of personal data without the consent of the personal data subject is not permitted, unless otherwise provided by federal law.
3.3. The Operator has the right to:
- Independently determine the composition and list of measures necessary and sufficient to ensure the fulfillment of obligations stipulated by the Personal Data Law and regulatory legal acts adopted in accordance with it, unless otherwise provided by the Personal Data Law or other federal laws;
- Entrust the processing of personal data to another person with the consent of the personal data subject, unless otherwise provided by federal law, on the basis of an agreement concluded with that person. The person processing personal data on behalf of the Operator is obliged to comply with the principles and rules of personal data processing provided for by the Personal Data Law;
- In case of withdrawal of consent to the processing of personal data by the subject, the Operator has the right to continue processing personal data without the subject's consent if there are grounds specified in the Personal Data Law.
3.4. The Operator is obliged to:
- Organize the processing of personal data in accordance with the requirements of the Personal Data Law;
- Respond to appeals and requests from personal data subjects and their legal representatives in accordance with the requirements of the Personal Data Law;
- Take necessary legal, organizational, and technical measures to protect personal data from unlawful or accidental access, destruction, modification, blocking, distribution, and other unauthorized actions.
3.5. The Personal Data Subject has the right to:
- Receive information related to the processing of their personal data, except in cases provided for by federal laws. The information is provided to the personal data subject by the Operator in an accessible form and must not contain personal data relating to other personal data subjects, unless there are legal grounds for disclosing such personal data. The list of information and the procedure for obtaining it are established by the Personal Data Law;
- Require the Operator to clarify, block, or destroy their personal data if the data is incomplete, outdated, inaccurate, illegally obtained, not necessary for the stated processing purpose, or for any other reasons determined by the personal data subject themselves, by sending a request to the email address: info@alme.agency.
4. Storage and Disclosure of Information
4.1. Storage of Personal Data
All personal data we collect is stored in our database in Poland. Access to your personal data is provided only to our staff and third parties who help us process and store data and are involved in the recruitment process. Some of them may be located outside the European Economic Area, and when transferring your personal data outside this area, we undertake to ensure the confidentiality of your personal data.
4.2. Disclosure of Personal Data to Third Parties
We may disclose your resume and related information to potential employers and our clients.
Other third parties to whom we may disclose your personal data include: pension scheme providers, tax and customs authorities, employment agencies, legal advisors, and other companies involved in pre-employment screening or payroll processing.
